Conditions of participation ‘Find the Golden Bar’

General information

The following conditions of participation apply to participation in the ESN Designer Bar competition ‘Find the Golden Bar’ organised by Fitmart GmbH & Co. KG, Werner-von-Siemens-Straße 8, 25337 Elmshorn (hereinafter referred to as ‘Fitmart’). By participating in the competition, the participant accepts the conditions of participation.

Fitmart GmbH & Co. KG (hereinafter ‘Organiser’) regularly organises or advertises competitions (hereinafter ‘Competitions’) via its Instagram accounts esn.com, esn.nl and esn.uk (hereinafter individually ‘Instagram account’ and collectively ‘Social Media Presence’).

The competitions organised by the Organiser on the Social Media Presence are not connected to Meta Platforms Inc. and its affiliated companies and are not the responsibility of, sponsored, supported or organised by Meta Platforms Inc. and its affiliated companies. All questions, comments, notices and complaints regarding competitions should be addressed to the Organiser and not to Meta Platforms Inc.

The competition is not affiliated with TikTok. It is not sponsored, supported or organised by TikTok, but exclusively by Fitmart GmbH & Co. KG, Werner-von-Siemens-Straße 8, 25337 Elmshorn, Germany. All questions, comments or complaints about the competition should be addressed directly to Fitmart GmbH & Co. K and not to TikTok.

The organiser expressly points out that the ‘Golden Bar’ is not a bar made of a precious metal (e.g. gold). The ‘Golden Bar’ merely serves to symbolise the possibility of redeeming it for the annual supply of ESN Designer Bars offered as a prize below. The ‘Golden Bar’ is not edible as it is a dummy.

Eligibility

All persons over the age of 18 who are resident in Germany, Austria, Switzerland, the Netherlands (excluding extra-European territory) and the United Kingdom are eligible to participate.

Employees of Fitmart and their relatives as well as employees and relatives of affiliated companies are excluded from participation.

Procedure and prize

The promotion period is from 05 June 2024 18:00 (CET) to 12 June 2024 17:59 (CET).

During the promotion period, the organiser will randomly add a total of 50 individual ‘Golden Bars’ to different 12-pack boxes of the ESN Designer Bar protein bar range (flavours: Almond Coconut, Fudge Brownie, Dark Cookie, Hazelnut Nougat, Peanut Caramel) or ESN Designer Bar Crunchy (flavours: Coconut, Chocolate Caramel, Hazelnut Nougat, Salted Caramel).

If the participant orders a box of 12 of the above-mentioned range (ESN Designer Bar Protein Bar flavour: Almond Coconut, Fudge Brownie, Dark Cookie, Hazelnut Nougat, Peanut Caramel or ESN Designer Bar Crunchy flavour: Coconut, Chocolate Caramel, Hazelnut Nougat, Salted Caramel) during this promotion period in the Promoter's online shop (esn. com, esn.nl or esn.uk), the participant has the chance to receive a ‘Golden Bar’ with their order and redeem it for a year's supply of ESN Designer Bars (24x 12-pack boxes of different flavours from the above-mentioned range).

You have won if you find one of the 50 ‘Golden Bars’.

The ‘Golden Bar’ can be found on a box of 12 of the above-mentioned varieties together with a flyer on which a number is printed to identify the ‘Golden Bar’.

The QR code on the flyer will take the winner to a landing page that explains how the prize will be delivered.

If the participant has found a ‘Golden Bar’ with flyer, the participant must contact goldenbar@esn.com by 30 June 2024 at 23:59 (CET) at the latest, stating the following points:

• Picture of the ESN Designer Bar 12-pack box of their order, the Golden Bar and the number on the flyer
• Order number from the promotion period esn.com, esn.nl or esn.uk online shops for ESN Designer Bar
• Email address at which the winner ordered via com, esn.nl or esn.uk online shop during the promotion period
  

The participant is responsible for the accuracy of the contact details provided. If the number given on the flyer is correct, we will contact the participant to discuss the prize processing.

Please keep the undamaged ‘Golden Bar’ and the flyer.

Fitmart will only confirm the prize after the requested data (name, shipping address, e-mail, address, order data) has been submitted. A damaged bar may be rejected by Fitmart as invalid. Communication fees will not be accepted.

Sending the prize for a Golden Bar

Once the prize has been confirmed, the ESN Designer Bar 12-pack boxes will be sent to the address provided by the participant. Delivery will only be made to the areas listed under eligibility. Fitmart is authorised to make partial deliveries and will deliver as follows: The winner will receive the first half of the ESN Designer Bar 12-pack boxes (12x 12-pack boxes of different flavours) immediately after confirmation of winning, the other half (12x 12-pack boxes of different flavours) 6 months later. Please note that the prize can only be delivered if the correct contact address is provided. Cash payment of the prize is not possible. The participant is not entitled to certain flavours of the ESN Designer Bar 12-pack boxes delivered as prizes. The selection of flavours is arbitrary and cannot be influenced.

Data protection

The personal data collected as part of the competition will be processed by the data controller within the meaning of data protection law (Fitmart GmbH & Co. KG, Werner-von-Siemens-Straße 8, 25337 Elmshorn, Germany) exclusively for the purpose of organising the competition. The participant recognises that Fitmart may forward the data to third parties commissioned with the implementation and processing of the competition, and in particular to affiliated group companies for these purposes. Data will only be transferred to third parties if this is necessary and permitted for the purposes of the competition and with express reference to the fact that participants' personal data may only be processed and used for the purposes of the competition. The data collected is used for clear identification and, if applicable, for prize notification. The personal data will be stored until the final conclusion of the competition or until the expiry of the retention periods under tax and commercial law and then deleted in accordance with data protection regulations. Miscellaneous

Fitmart accepts no liability for loss of data, in particular in the course of data transmission, or other technical defects. Fitmart reserves the right to exclude participants from the competition due to false information, manipulation or the use of unauthorised aids. The excluded participant has no claims against Fitmart. In such cases, the prize may also be subsequently cancelled and reclaimed. Fitmart also reserves the right to modify the competition at any time or to terminate it prematurely without giving reasons. Fitmart reserves the right to change the conditions of participation at any time. Legal recourse is excluded. The law of the Federal Republic of Germany is exclusively applicable. Should individual provisions of these conditions of participation be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes as close as possible to the invalid provision in a legally permissible manner. All information is provided without guarantee. In accordance with § 36 VSBG, we would like to point out that we do not participate in dispute resolution proceedings before a consumer arbitration board.
